Home care terms of service

This agreement supersedes all previous agreements and only the details contained herein, as applicable to the particular services being purchased, shall apply to this arrangement.


A. Where this agreement is to purchase accommodation with personal or/and nursing care

  1. This agreement is subject to the conditions set out in the council's current 'Terms and Conditions of Accommodation in the Independent sector - Care Homes which provide personal care and nursing care', and for nursing placements, the 'Contract Conditions for National Health Service Funded Nursing Care in Derbyshire, Contributions and Continence Products Payments', copies of which may be obtained from the Director of Adult Social Services, County Hall. Matlock, DE4 3AG.

  2. If the registered provider achieves the standards required to qualify as a quality premium registered provider and this placement meets all quality premium requirements, the fee will include a quality premium payment. This element may be removed if the Registered Provider has its quality premium status suspended.

  3. Should the resident's contribution change, the resident and/or the resident's representative and the registered provider will be notified of the revised contribution and this agreement shall still apply to the revised financial arrangements as detailed on the payment advice sheet.

  4. Upon failure of the resident or the resident's representative to pay the required contribution, the Non-Payment Notification Procedure will commence (as set out in the Terms and Conditions of Accommodation in the Independent Sector).

B. Where this agreement is to purchase respite day care for older people

  1. This agreement is subject to the conditions set out in the council's current 'Terms and Conditions for Respite Day Care for Older People in the Independent Sector', copies of which may be obtained from the Director of Adult Social Services, County Hall, Matlock, DE4 3AG.

  2. Should the attendee's contribution change, the attendee and/or the attendee's representative and the registered provider will be notified of the revised contribution and this agreement shall still apply to the revised financial arrangements as detailed on the payment advice sheet.

  3. Upon failure of the attendee or the attendee's representative to pay the required contribution, the Non-Payment Notification Procedure will commence (as set out in the Terms and Conditions of Accommodation in the Independent Sector).

C. Where this agreement is for the provision of home care

  1. This agreement is subject to the conditions set out in the Derbyshire Home Care Framework Ref SSD 23 21 copies of which may be obtained from the Director of Adult Social Services, County Hall, Matlock, DE4 3AG.

  2. In the event of a cancelled care call, payment only be made for travel as per the terms of the Derbyshire Home Care Framework Ref SSD 23 21.

  3. Short-term packages of care as defined in the Derbyshire Home Care Framework Ref SSD 23 will be subject to clause 9 of Schedule 2 of the Main Master Block Adult Care Service Contract SSD 23 21, which forms part of the terms and conditions applicable to each call off from the framework: where providers deliver a short-term service and an end date to the package is provided, then no notice period will apply once the package ends. If no end date is provided and the duration is unknown to the provider, then the 14-day notice period will apply, unless a shorter notice period (typically 5 days) is agreed with the provider.
