About the Section 10 Order
The Section 10 Trunk Road Order is the legal mechanism that enables a highway, or a new highway that is proposed to be constructed, to become part of the national trunk road network. Once designated as a trunk road, responsibility for the highway transfers to the Secretary of State and is typically managed and maintained by National Highways on behalf of the Government.
Why the order is needed
The proposed scheme includes new road infrastructure that will connect directly to the Strategic Road Network. As these elements form part of the function and operation of the trunk road network, they need to be designated as trunk road in order to ensure they can be operated, maintained and managed by National Highways.
Without the Section 10 Order, these roads would remain the responsibility of the local highway authority. The Order therefore provides the legal basis for transferring the relevant sections of highway into the trunk road network.
What the order does
The order would:
- Designate the highways described in the Order as trunk road;
- Transfer responsibility for those highways from the local highway authority to National Highways;
- Ensure the new road infrastructure forms part of the Strategic Road Network;
- Enable the roads to be managed and maintained as part of the national trunk road system; and
- Provide continuity of responsibility for the safe and efficient operation of the trunk road network.
Affected parts of the scheme
For the South Derbyshire Growth Zone scheme, the Section 10 Order is proposed to apply to those elements of the scheme that connect directly to the A50 trunk road, including the new slip roads and associated sections of the junction infrastructure, together with laybys north and south of A50 trunk road to the west of the scheme. These parts of the scheme will become trunk road upon completion and opening to traffic.
