Land and premises

The 2004 Planning and Compulsory Purchase Act (amended 2008) sets out the system for preparing planning policy documents.


These documents contain policies and proposals for the development and use of land.

The plans which must be prepared are:

  • Local Development Frameworks which are folders of local development documents jointly prepared by the county and city councils for minerals and waste matters. Derby City Council, borough and district councils and the Peak District National Park Authority prepare Local Development Frameworks for other planning matters in their areas.

National and local policies

The National Planning Policy Framework, first published in March 2012, sets out the Government’s planning policies for England and how these are expected to be applied. The planning practice guidance to support the framework is published online and regularly updated.

The framework acts as guidance for local planning authorities and decision-takers, both in drawing up local development plans and making decisions about planning applications.

The Localism Act 2011 abolishes Regional Spatial Strategies, but there is a duty for interested parties to co-operate in the preparation of development plans.

Local plans for minerals and waste matters will still be jointly prepared by the county and city councils.

Derby City Council, borough and district councils and the Peak District National Park Authority will prepare local plans for other planning matters in their areas.

Local communities and businesses are given powers to prepare their own Neighbourhood Development Plans.
