Rights of way declaration register

The statutory declaration register is maintained under Section 31A of the Highways Act 1980. The register contains statements and maps that landowners have given to us, and the associated declarations.


We've introduced a scale of charges for deposits made pursuant to Section 31(6) of the Highways Act 1980 and Section 15A(1) of the Commons Act 2006:

  • areas of land up to 100 hectares - £325
  • areas of land 100 to 500 hectares - £380
  • areas of land 500 to 1,000 hectares - £430
  • areas of land in excess of 1,000 hectares - £500

The scale of charges may be subject to review in the future.

The scale of charges shows the basic fee for logging an application, making it available on the website and register, placing notices on site where required and sending notifications.

Please note the fee is for each individual application, lodging a Highways Act declaration following the deposit of a statement will constitute a separate application. Submitting an application under both Section 31(6) and Section 15A together on the same form will only incur a single fee.

Where an application involves more than one parcel of land, each additional parcel of land is subject to an additional fee of £50.00, for example where parcels are separated by adopted highway maintainable at the public expense.

Making a declaration does not affect any rights which may have been gained through public use prior to the date of the declaration.
