Admitted body status

Admitted bodies either become employers in the LGPS as a result of a TUPE transfer, or following an application to the fund to become an employer in the scheme. In both cases, an admission is subject to the body meeting the eligibility criteria and an admission agreement being signed by all relevant parties.

Schedule 2, Part 3 of The Local Government Pension Scheme Regulations 2013: LGPS Regulations and Guidance details the admission bodies with whom the Derbyshire Pension Fund may make an admission agreement. Most admission bodies fall under Schedule 2, Part 3, 1(a) or a(d) (i):

  • 1(a): a body which provides a public service in the United Kingdom which operates otherwise than for the purposes of gain and has sufficient links with a Scheme employer for the body and the Scheme employer to be regarded as having a community of interest.

  • 1(d)(i) : a body that is providing or will provide a service or assets in connection with the exercise of a function of a Scheme employer as a result of- (i) the transfer of the service or assets by means of a contract or other arrangement.

An admission agreement as defined by the LGPS regulations 2013 is an agreement between an administering authority and an admission body that named individuals, or all or any specified class of the admission body’s employees, may be members of the scheme.

All prospective new employers need to complete an application process to join the Derbyshire Pension Fund. The process of admission can take several months and it is essential that both the ceding employer and new employer contact the fund at the earliest opportunity.
