We have a deputyship team, within our Adult Care department.
The team administers the financial and property affairs of Derbyshire residents who lack the mental capacity to do so themselves and where no other willing or suitable alternative applicant exists. The team can also offer support to family or friends who intend to take on the application themselves.
The team offers its service to people in care and in the community and is fully committed to acting in the best interests of its clients, ensuring their assets are safeguarded and their needs met. Ongoing consultation with the clients themselves, their related professional workers and any advocates and interested parties will always be undertaken to determine how a client's needs are best met.
All Court of Protection appointed deputies must sign a declaration committing to take all decisions relating to clients' affairs as though they were their own and this would apply to all investments and decisions about property.
Like any other Court appointed deputy, the authority has to provide annual accounts to The Court of Protection showing income and expenditure and justifying expenses.
Fees and costs
Please note that this is not a free service to the clients as there are significant and unavoidable expenses in making such applications.
As well as the recovery of the fees due to The Court of Protection and Office of The Public Guardian that are incurred in making the applications (an average of £600 per application) the Court of Protection has dictated fixed sums that are recoverable by Local Authority Deputies for the work completed and ongoing service provided.
Additional costs to the Authority (e.g. Mileage) may also be recoverable but no additional sums are chargeable at this time for the work and time involved in the administration of the cases.
