Internal Dispute Resolution Procedure (IDRP)
Since 1 June 2004 a formal dispute procedure has been in place for the Local Government Pension Scheme. The formal dispute process is known as the Internal Dispute Resolution Procedure (IDRP).It is a two stage process, although most cases are normally resolved before stage 2.
Stage 1
If a member is dissatisfied with a decision made regarding their pension scheme benefits they should initially contact us explaining what they feel is wrong. We will then review the case and provide a reply. Most cases are solved at this point.
However if this does not resolve the dispute the process is as follows:
If the employer has made the decision that the member is disputing, the member can refer the dispute to a person specified by their employer.
All scheme employers should have a nominated person for their IDRP process.
This stage is a formal review of the initial decision and is an opportunity to reconsider the matter. The member needs to complete the IDRP form at this stage and send it to their employer's nominated person.
The employer should make sure we are kept aware of the dispute.
If the member is disputing the decision of Derbyshire County Council as administering authority the IDRP forms should be sent to Kay Riley, Assistant Director of Legal Services.
The disputes procedure only applies to the main pension scheme and can not be used for other areas such as awards of compensation.
Stage 2
Should the member still be dissatisfied after receiving the stage 1 decision the matter can be referred to Derbyshire County Council as administering authority for determination.
Our Pensions Committee will normally consider stage 2 disputes.

There are clear timescales for each stage of the IDRP process that are detailed in IDRP form.
