Minerals Local Plan

We have prepared a local plan for minerals - the plan was prepared jointly with Derby City Council and covers the area of Derbyshire outside the Peak District National Park. 

It contains land use policies for all the mineral resources in Derbyshire, including sand and gravel, crushed rock, industrial limestone and coal.

The plan was adopted in April 2000 and covers the period up to 2006. 

From 27 September 2007, following a Government Direction, the following policies are no longer to be used, as they have expired:  MP8, 9, 14, 20, 26, 30 and 31.

It aims to provide for the future supply of minerals, whilst ensuring that the environment is satisfactorily protected. 

It describes the detailed criteria that will apply when proposals for mineral working are considered, and sets out the requirements for restoration and aftercare.

First alteration - coal policies 

In November 2002, (in conjunction with Derby City Council) we made an alteration to chapter 13 of the adopted plan to take account of new Government guidance on coal mining and colliery spoil disposal. 

The main change was to introduce a general presumption against coal mining and colliery spoil disposal unless certain criteria are met.

Supplementary planning guidance on the after-uses of sand and gravel sites 

Whilst consulting with the public during the preparation of the Minerals Local Plan, there was much discussion about the way sand and gravel sites should be restored after mineral extraction had finished.

Consequently, a commitment was given in the plan to prepare Supplementary Planning Guidance (SPG) on the most appropriate after-uses for these sites.

The county and city councils jointly prepared a draft SPG which was published for public consultation in May 2004. The consultation exercise resulted in a number of comments which were carefully considered. 

Where appropriate, decisions were made to make changes to the consultation draft and adopt the revised document as the finalised adopted edition of the SPG.

The SPG gives particular attention to which sites should be filled and reclaimed for dry uses - rather than water-based uses. Bearing in mind the scarcity of suitable fill materials and the issue of aircraft safety in relation to bird-strike risk. 

Although the SPG does not form part of the development plan, it carries substantial weight when planning decisions are made. It will be taken into account in determining planning applications for sand and gravel working in the Trent, Lower Derwent and Lower Dove valleys.

On adoption of the SPG councils are required to publish a statement of the consultation undertaken, the comments received and the councils’ response to those comments.
