Minerals and Waste Development Framework

The Derbyshire Minerals and Waste Development Framework is a collection of documents setting out the county and city councils’ planning policies for future minerals and waste development.

These documents will provide for future development, including the identification of sites for mineral extraction and waste management, where necessary.

They will also establish how the principles of sustainable development in a policy framework will be applied in considering relevant development proposals that are put forward.

The Derbyshire Minerals and Waste Development Scheme describes the new local development documents that are to be prepared and sets out the process for preparing them, including their scope, timescale, transitional arrangements and monitoring processes.

The scheme informs the public of what we are proposing and when, and at what stage, people can expect to be involved in the process.

The Derby and Derbyshire Minerals Local Plan was adopted in 2000 and updated in November 2002 when the authorities formally adopted an alteration to its coal policies. Its policies have been ‘saved’ (apart from MP8, 9, 14, 20, 26, 30 and 31) as part of the development plan until they are replaced by new mineral development plan documents.

Supplementary Planning Guidance on the After-Use of Sand and Gravel Sites was adopted in December 2005. This carries significant weight in supplementing the saved policies of the adopted Minerals Local Plan.

The Derby and Derbyshire Waste Local Plan was adopted in March 2005. It contains a Waste Planning Strategy, which guides its objective-led approach. Its policies are 'saved' (apart from W1a) and will continue to provide an appropriate strategic and general policy framework for waste development proposals.

The Statement of Community Involvement (SCI)  sets out how we intend to involve the community in the preparation of all the planning documents. It was formally adopted in December 2006.

The Annual Monitoring Report 2007/2008 for the Minerals and Waste Development Framework was published in December 2008. It contains information on the progress in the implementation of the Development Scheme and on the effectiveness of saved policies in the Minerals and Waste Local Plans.

Aggregate Minerals Sites Allocations and the Waste Sites Allocations DPDs

Work on the Aggregate Minerals and Waste Sites DPDs was abandoned in December 2008.

Statements to Assist Applicants in the Preparation of Planning Applications for Aggregate Mineral and Waste Developments.

The councils have prepared two statements (for aggregate minerals and waste) to assist prospective applicants in making applications for future development until the Core Strategies are in place.

The statements identify those parts of the Development Plan, other policies, and evidential matters (‘the evidence base’), which would be significant factors for the relevant Council to consider in deciding whether or not, or in what form, to grant planning permission. They draw upon the site evaluation work undertaken in the preparation of the abandoned Sites DPDs.

Minerals and Waste Core Strategies

A Core Strategy is a plan which sets out the planning policies and proposals of a council for the future development of all or part of its area. As a county council, we are responsible for minerals and waste development in Derbyshire.

We began the preparation of the Minerals Core Strategy and the Waste Core Strategy in March 2009. We notified interested people and organisations of the opportunity to be involved in the process of preparing them and for any initial opinions on what the documents should contain.

We held a workshop in July 2009 with people who have an interest in waste and minerals in Derbyshire.

The comments provided by the participants will inform the preparation of the core strategies. These can be found in the "Latest News" section on the left hand side of this page.

As part of the process of preparing the two Development Plan Documents (DPDs), we have to prepare a Sustainability Appraisal (SA) of the effects of each of the plans on environmental, social and economic resources. Sustainability Appraisals are complex documents, which are prepared in accordance with Government guidance and regulation.

We have now prepared the draft of the Joint “Scoping Report” for the Sustainability Appraisal (SA) of these two DPDs. A copy of this may be viewed in the related documents section.
