The Derbyshire Minerals and Waste Development Framework is a collection of documents setting out our planning policies for future minerals and waste development.
These documents will allow for future development, including identifying mineral and waste sites where necessary.
They will also establish the principles of sustainable development in a policy framework for considering all proposals that are put forward.
The Derbyshire Minerals and Waste Development Scheme is the project plan which sets out the process by which the local development documents will be prepared, including their scope, timescale, transitional arrangements and monitoring process. This can viewed from the more information section on this page.
It informs the public of what we are proposing to do and when and at what stage they can expect to be involved in the process. The current Scheme was adopted in December 2006 and can viewed in the more information section of this page.
“Saved” Policies. Under the new system, some policies of existing plans can be “saved” for a period as part of the statutory development plan. As such, they will be included in the new development framework. Saved policies are included in the following plans:
The Derby and Derbyshire Joint Structure Plan (adopted 2001) which contains general, strategic policies for minerals and waste development. A number of policies within this plan will be “saved” as part of the development plan until the adoption of the reviewed Regional Spatial Strategy. The Derby and Derbyshire Minerals Local Plan was adopted in 2000 and updated in November 2002 when the authorities formally adopted an alteration to its coal policies. Its policies have been ‘saved’ as part of the development plan until progressively replaced by minerals development plan documents. When the aggregates minerals site allocations development plan is adopted (see below), it will replace the aggregates site allocations chapters of the local plan (chapters eight, nine, 10, 11 and appendices A and B).
Supplementary Planning Guidance on the After-Use of Sand and Gravel Sites was adopted in December 2005. This carries significant weight in supplementing the saved policies of the adopted Minerals Local Plan. Upon replacement of the aggregates sites policies, it may be necessary to prepare a new Supplementary Planning Document to replace this guidance. The Derby and Derbyshire Waste Local Plan was adopted in March 2005. It contains a “Waste Planning Strategy”, which guides its objective-led approach. Its policies are “saved” as part of the development plan and will continue to provide an appropriate strategic and general policy framework for waste development proposals. The plan does not contain site allocations and therefore the preparation of a waste sites allocations document is a priority task.
New Local Development Documents
The Waste Site Allocations Document will contain policies identifying sites that are suitable for waste management development in the context of regional and sub-regional policies, targets and priorities.
The document will demonstrate how the identified sites and other local provision will provide sufficient capacity for the municipalities and other organisations and businesses of Derby and Derbyshire to move towards sustainable management of their waste in the period to 2020.
Preparation of the waste site allocations document has reached the stage of “Pre-submission Public Participation”, with publication of the councils’ Preferred Options Report and the sustainability appraisal in September 2007.
The Minerals Site Allocations (for Aggregates) Document will contain site-specific policies and may identify areas of search to make provision for crushed rock and sand and gravel production up to 2019,.

The Minerals Core Strategy Development Planning Document and Minerals Development Control Policies documents will be prepared in due course. In the meantime, the saved minerals local plan contains suitable up-to-date policies which will fulfil the role of these documents.
The Waste Core Strategy Development Planning Document and Waste Development Control Policies documents will be prepared in due course. In the meantime, the Waste Local Plan contains a waste planning strategy, and contains a range of policies which will fulfil the role of these documents.
The Proposal Map Development Plan Document will illustrate all the policies set out in the development plan documents in a way that is easily accessible to local communities and stakeholders.
The Statement of Community Involvement(SCI) has been prepared as the first priority in the production of the Minerals and Waste Development Framework, as it sets the ground rules for community involvement in the preparation of all the planning documents. It was formally adopted in December 2006. All Development Plan Documents that we subsequently prepare, and planning applications we determine, will have to be in accordance with the procedures set out in the SCI.
The current Annual Monitoring Report 2006/2007 for the Minerals and Waste Development Framework was published in December 2006. It contains information on the progress in the implementation of the Minerals and Waste Development Scheme (MWDS) and on the effectiveness of saved policies in the Minerals and Waste Local Plans and can viewed in the more information section of this page.
