Infrastructure Planning

Derbyshire will change and grow over the next twenty years. To help ensure infrastructure is funded and delivered in a coordinated and timely manner we have carried out infrastructure planning.


Infrastructure planning

Development can have a positive effect on an area, providing new homes, jobs and economic prosperity. However it can also place pressures on the county's infrastructure, services and facilities.

It is vital that ongoing investment in infrastructure and services is secured, to support our communities and accommodate change.

Two potential sources of funding for infrastructure are the new Community Infrastructure Levy (CIL) and developer contributions (Section 106 planning obligations).

Community Infrastructure Levy

CIL is an area-based tariff and the amount to be paid and the type of development that will be charged is set out in a document called a Charging Schedule.

We are not a CIL charging council but we can collect funds from local planning authorities if agreed with them in advance. You can find out more about the Community Infrastructure Levy on the Department for Community and Local Government website (opens in a new window).

Developer contributions 

Developer contributions (Section 106 Planning Obligations) can be used to help mitigate the potential negative impacts of new development and minimise any loss or damage to services and facilities and environmental resources.

In addition to planning conditions, planning obligations can be used where they would help to make new development proposals acceptable.

To help ensure infrastructure is funded and delivered in a coordinated and timely manner we have prepared two documents which are now out for public consultation.

Derbyshire Infrastructure Plan

The Derbyshire Infrastructure Plan sets out our communities' current and future needs and spending priorities for infrastructure and service delivery.

The Derbyshire Infrastructure Plan should be used by county council departments, local planning authorities and the development industry to inform local policy and strategy, funding bids, spending priorities and decisions on future investment.

Local planning authorities should use the Derbyshire Infrastructure Plan to inform their CIL Charging Schedules and associated 'Regulation 123' list of spending priorities.

Developer Contributions Protocol

The Derbyshire County Council Developer Contributions Protocol is a guidance tool for use by developers and local planning authorities.

It sets out our expectations for contributions towards infrastructure and services required to support growth and development in Derbyshire.

At the moment this is a guidance document only. We acknowledge that developer contributions cannot fund everything. The need for contributions will therefore be assessed on a case by case basis, using the protocol as a starting point for negotiation.

In line with legal requirements contributions will only be sought where they are necessary to make the development acceptable; directly related to the development; and fairly and reasonably related in scale and kind to the development.

The Derbyshire County Council Developer Contributions Protocol relates only to our services and infrastructure. It does not cover contributions that may be sought separately by local planning authorities for local infrastructure such as affordable housing or open space.
