Tree Preservation Orders

We are responsible for administering our Tree Preservation Orders (TPOs) which involves safeguarding both individual trees, groups of trees and woodlands.

We manage around 180 TPOs covering trees and woodland throughout the county.

TPOs are protected trees and it is an offence to cut down, wilfully damage, prune or do any other work on them without the proper permission. However, there are certain legal exemptions.

You can view current Tree Preservation Orders using the Derbyshire Partnership Mapping (opens in a new window) Portal.

If you wish to carry out work on a tree affected by a Tree Preservation Order you will need to make a formal application using the form provided in the more information section on this page.

Please note: you will need to submit an accurate location plan with your application.

There is no charge for submitting an application and we aim to determine your application within eight weeks of receipt.

Advice on completing your application

Print off and complete the form to seek permission. You should specify the trees you want to work on, what work you want to do to them and reasons why you want to do the work.

When completing the form you must include the following information:

  • Full name, address and daytime telephone number of applicant

  • Full name and address of the owner of the tree(s) if this is different to the applicant

  • A description and accurate location plan clearly showing the location of each tree. If the application involves more than one tree, each tree should be numbered on the location plan and schedule of work

  • Full details of the tree work you wish to carry out – it is not sufficient to just apply for “pruning”, you must describe the type and extent of pruning. If you are uncertain of what pruning you wish to do, it may be useful to seek the advice of a tree surgeon or arboricultural consultant before filling in the application form.  Alternatively, you can contact the Tree Preservation Officer to arrange a pre-application site meeting to discuss your proposals.

  • The application form is dated and signed at the bottom

  • Statement of reasons as to why you wish to undertake the tree work

In addition, you may wish to submit other information to support your tree work application. Depending on circumstances, this may include the following:

  • Subsidence reports

  • Structural surveys

  • Tree inspection reports

  • Photographs
